you're watching cbs 5 eyewitness news on the cw. he's not jumping ship, but the man at apple's helm is letting go. who is stepping in to take charge and how apple loyal ists are taking the news. what firefighters already on the scene did to make that job even harder. >> customers want better, but they apparently want it to be pleasing at the same time. the fight over at&t's proposal to improve service in the bay area. and the city got federal help fighting crimes. why people in the south bay were cheering that decision. good evening, i'm dana king.

>> and i'm ken. a silicon valley giant is calling it quits. nobody bigger than this guy, steve jobs stepped down as ceo of apple, saying he can no longer do the job. we have team coverage on the announcement that sent shock waves through the tech world. linda yee spoke with apple customers. we begin with kit in cupertino. >> steve jobs said he could no longer fulfill the duties and expectations as ceo. the news went viral and within minutes all of the employees knew. it was long awaited. long expected, but a shock nonetheless. the apple employees that were talking at the company's headquarters had nothing but nice things to say. >> he's a good guy, good boss. a good company. >> oh, wishing the best everything in life. >> steve jobs was last seen in

public in june, coming back briefly from medical leave. but he didn't seem to miss a beat. no other ceo is aligned with their company's brand quite like jobs, which begs the question, is apple still apple without steve? >> you don't find another one of him. that is like lightning in a bottle. you must now bring together a team that can close that void. that's a tough one. it's a different game at that point. >> before there was this. >> iphone 3g. >> there was this. >> he presented the first macken tosh in 1984. at the time, hardly anyone noticed. it was a model that would define an era. guiding the apple ship against golioth foes. >> we have to let go of this notion that for apple to win, microsoft has to lose. >> reassuring employees and investors during unprofitable

years in the early 90s. >> if you want apple to succeed, then you want someone to give you good news, and in that context it was good news. >> and laying out a new vision of a new kind of tech company. >> we are fund fundamentally changing the way we do business. >> year after year, clad in the iconic jeans and black t- shirt, jobs rolled out an arsenal of technology. >> every once in a while a revolutionary product comes along that changes everything. >> jobs ushered in the age of the smart phone and with every new apple product, another mountain of cash. tim cook has been named the new ceo. he proved he can build high quality products and ship them out on top. apple's short-term plan is solid, but beyond that, the company needs another visionary. >> i don't think apple can be the same a year or two from now. they will start to vary.

someone has to run that company. there has to be new leadership and in this business, you don't come in to run a company to babysit it and carry out what steve used to do. that's a formula for disaster. you need vision. >> and apple stock is going down 5%. the big test will come tomorrow morning at the opening bell on wall street. with more on how the apple faithful are handling the news, linda has that. >> it didn't take long for the buzz to talk about that resignation. and while the reaction was strong here, the question really is, will they remain faithful and buy all future apple products? >> he's as iconic as his company symbol and steve jobs decisioned to step aside stunned legions of apple addicts. carlos is the ultimate apple consumer. he is carrying his apple mac book, ipad, and an iphone.

he's not so sure if he could be as quick to buy the next cutting edge apple product. >> i thought of apple being steve jobs. it's kind of, if he's not there anymore, it's a different company. he is pretty much the brain child and heart of the whole operation. >> but many more of apple's core fans say even if jobs isn't hands on, they'll still buy. >> he's really left his mark on the company. i think they know his vision, his philosophy. i still have a lot of faith in apple and its products. >> this is an unbelievable organization and it's a tribute to him in what he created. i don't think this is about one person. >> some admirers are looking at the leadership. tim cook. >> i think there's going to be an evaluation discount that compresses because he leaves and the new boss, i think it's tim cook or someone. >> for now. >> he has to prove to everybody he is worthy and

probably nobody is as good as steve jobs, right? >> as apple's stock took a nose dive, the faithful are still crowding the stores. >> i would never buy a pc, never. >> and even though they do have a lot to prove the next few days to see how it will happen, this store was crowded and the talk is still, where's iphone 5? i'm ready to buy it. >> they still sell all kinds of products and people flock to them. linda yee and kit reporting on this story. thank you both. a rail tanker full of propane is burning tonight more than 24 hours after it caught fire. that fire is raging in the city of placer county. specially trained reenforcements have been called from out of state to contain the flames. the newest tactic that crews are taking. mark. >> very dramatic scene here in lincoln. take a look. over my shoulder, you can see

this propane tank is burning at this point. within the last hour, crews have been on top of that tanker, literally in the flames as they work on several plans to extinguish these flames and get residents back into their homes. >> these aerial pictures, the latest effort to extinguish the flames is what is called a hot tap. it involves cutting through the outer steel shell on the tank and using a special tool to cut through the inner tank which contains the propane to install a valve and a pipe. the propane will be funneled into an open pit. >> initially the plan was to have the hot tapping procedure well underway by now and actually it is. it's going slower. >> lincoln fire chief says the latest problem for the special team from texas is all the water, which fire crews have been putting on the tank. >> it's a muddy mess out

there. they are having to prep the site so it's safe and effective for them. more importantly, if something were to go wrong, good footing so they can get out. while crews work to contain the fire, the residents of 4800 homes within a one mile radius of the burning tank are left with nothing to do but wait and hope. >> it's been real rough and it's hot. >> mary winters is one of the evacuees. >> went to the market about two miles away from my house. i tried to come back, 20 minutes later, it was blocked off and i couldn't get in. >> jenny is 20 months months pregnant and her and her family are among those staying here. >> they said you have to get out. this could explode and we ran out and got everything that we could. we spent the night in our car last night and we've been here ever since. >> despite the on going fire

and evacuations, the fire chief says this community has many things to be thankful for. >> positive side is, it could have been a whole lot worse, because we are looking at craters, injuries, death perhaps. a lot of problems. >> back to a live picture here in lincoln. two approaches being used at this moment. water is being forced into that tank in an effort to push the propane out and allow it to burn off and if that plan is unsuccessful, they're going to go with the second plan, which is digging a pit and burning it out of the tank itself. so they are using a two-pronged approach. the goal is to get residents back at 8:00 a.m. >> i would think this hot tapping, where the special team has to go in. the risk must be significant to them. >> reporter: oh it is indeed. absolutely. that's why this team from houston, texas, they specialize in this thing. that's why they are here.

this is a case where fire is a good thing. some people asked why not put the fire out and let the gas run out. if you have a bunch of propane in the air and someone's hot water has a spark, it could be a bigger problem. they want to see what they are seeing. they want the flames. today officials back east inspected the damage from yesterday's rare 5.8 earthquake in the nation's capital. the washington monument remained closed indefinitely after exterior cracks were discovered. the national cathedral also sustained damage. politicians in virginia put things in perspective today. >> this was where we have fires in the great dismal swamps. we have a hurricane approaching from the southeast and the last thing i think everybody expected at 1:51 p.m. yesterday was an earthquake. >> yeah, some schools around

mineral, virginia, were damaged and closed for the next eight days. her son was killed and she wants you to remember. how a bay area mother is reminding everyone of her son and his unsolved murder. it could have been a heist for the history books, but the robbery went a little sideways. now one person is dead. another is in jail. what happened when they tried to steal an armored car? >> and a south bay city gets federal help fighting gangs. two months later, it says thanks, but no thanks. why a successful program is being scrapped. i'm the meteorologist in the cw weather center. nice day today, now the fog is trying to surge on shore. we'll talk about that, plus hurricane irene. where she's headed in the latest coming up next. come on out, guys. the jury has reached its decision. now, you guys found the other airline guilty of charging a 150-dollar change fee. you bet! southwest would never do that. and that was after she changed her flight and paid the difference in airfare. that other airline treated her wrong. she was understandably upset. well, who can afford a 150-dollar change fee? he was surprised with the verdict. you got that right. [ male announcer ] don't pay a change fee on top of a fare difference. fly southwest, the only major airline that never charges change fees.

son's killer. the mother of a murdered hayward teenager is hoping a new campaign can help find her son's killer. the group put up this billboard on a street and mission in heyward. that's where 17-year-old samuel was murdered last may. it happened when a gunmen opened fire into the car samuel was riding in. striking and killing him. >> this is another plea to the community where people to step forward, people to come forward. there are many people i know that are out there and have information in regards to samuel's murder and they are scared to come forward. >> police have not identified any suspects or a motive in samuel's murder. an attempted bank robbery turned into a deadly shootout in the east bay today. one suspect is dead tonight.

three people including a police officer are hurt. it happened outside of wells fargo in the crossing shopping center. juliette tells us how it unfolded. >> it's scary, it's like, here it is going to the store to get breakfast. >> witness darius johnson was caught in the cross fire. two armed suspects tried to rob an armored guard outside wells fargo bank on fitzgerald drive. that's when shots rang out. >> there was a gunfight, so to speak, on the fitzgerald side of the wells fargo bank. >> a female guard was shot and injured in the cross fire. a police officer responding to the incident was shot in the shoulder. one of the suspects was shot and killed. the other suspect tried to flee the scene. >> he was attempting to run across the street and all of a sudden i saw a couple shots

fired and i saw his body drop to the ground. >> police believe the other suspect managed to drive himself 15 minutes away to doctor's medical center to be treated for a gun shot wound. >> we believe that suspect was involved in a gunfight prior to pinole police arrival with a member and armed security guard from the truck who was also shot. >> i didn't know what to do. i saw it was away from me, so i stayed where i was at. they directed me over here. >> the police officer has been with the police department for two years. before that he was in the air force. >> he is diligent. he's a school resource officer. he's one of those guys, he's a very large individual, but he has a heart of gold. >> while the fbi was called in to investigate, streets were closed off, shopping centers closed down. this couple couldn't make their bridal appointment today. >> i'm going to try to go to

david's bridal to pick out my wedding dress and bridesmaid dresses. >> are you able to go in there? >> i don't know. we have to see if we can sneak past them. >> the police officer and the armored guard are expected to survive. as for the suspect who drove himself to the hospital, once he's released, he will be sent straight to jail. juliette goodrich, cbs 5. san jose police department today announced the end of its partnership with federal law enforcement agencies. homeland security and ice have been working with san jose police to curb gang violence since operation community shield has been unveiled, there have been no gang related homicides in the city. activists that were worried it would lead to a crackdown of illegal immigrants expressed relief today. >> to acknowledge and thank the chief of police for listening to the community's concern about ice and

terminating the contract that he had with ice and san jose. >> the san jose police department held a meeting addressing immigrant concerns. how to interact with law enforcement amid safety report crimes was discussed. a lawsuit filed today could put the brakes on a plan to boost cable and internet service in san francisco. the city gave at&t permission to install up to 726 metal boxes, just like these on sidewalks around the city. but a lawsuit filed by several neighborhood groups is asking for an environmental impact report before that work can begin. the neighbors say that they are against anything that clutters the streets. >> i personally think it's a great idea. i think we need a challenge to comcast. i think monopoly never helps. it means better cable and tv rates and it means hundreds of new jobs. >> last month the board of supervisors approved the proposal by a 6-5 march 6-5

margin. >> be prepared, that's the warning going up and down the east coast tonight. hurricane irene is a category 3 storm right now as it moves through the bahamas. thousands of people were told to leave because of torrential rains, flooding, and winds up to 120 miles per hour. irene expected to hit north carolina over the weekend and could make its way as far north as maine. >> obviously every three hours, we know more than we knew three hours ago and we are trying to stay on top of it and figure out what's going to happen. >> storm satellite image is 800 miles across. irene is expected to become a category 4 storm by tomorrow. >> that is a big one. bat down the hatches. we're going to check in with lauren and see where that is headed. >> very scary storm and it's picking up strength. right now running over some mountainous regions as you make across some of the islands. likely run into category 4 as

we head in toward tomorrow and scoot right up along the coastline. north carolina, possibly making land fall in through new england. in the meantime, here in the bay area, it's all about that fog. boy, it is very thick out there. we are also seeing some drizzle at this hour. it looks like a cooldown is in the works in some parts of the bay area. some 80s and low 90s. warm to hot. down at the coast, low clouds and fog and that drizzle will continue. 65 degrees in liver more. 54 degrees in san francisco. it looks like we are going to see that fog stretch into the bay, but probably not make its way to the valley. the valley should stay clear overnight. the high pressure is weakening. temperatures will cool down just a little bit, but then as we head towards the weekend, starts to warm up. we'll keep you cooler toward the beaches.

numbers mainly into the 60s. we're looking for 70s in toward redwood city. in san jose by the afternoon, some 80s and low 90s well inland. you get the idea. some nice weather. cooler than what we've had. temperatures will continue to drop a couple, but yup, we are going to heat things up, maybe sop offshore winds. we would get sunshine all the way to the coastline. they have not seen sun out at the beaches. they would be happy. >> summer, all year. >> it doesn't feel like there has been one. >> thanks lauren. well, it is one of the few areas where the limit is limitless. professional sports. how the nfl salary cap does and does not work in tonight's good question. hi...do you happen to have any brilliant silver altimas?

every player that suits up for an nfl team has to sign a contract before they even step on the field. >> right now in training camp, all the players, you have to have 51 players that count toward your cap. >> the cap. more formerly known as the salary cap. that's the sum of all your player salaries for that year. hugh jackson thinks it made the nfl very competitive. >> it levels the playing field for all the teams. here's the number you must be at. you can't be a dollar over it. >> when it went into effect in the 1994 season, the cap was only $34.7 million. it peaked in the 2009 season at $128 million and has since dropped to $120 million with the 2011 nfl labor agreement. but here's where it gets
